I have an old 9700 pro in my other rig that just went.Its about 2 years old?Will ATI accept this back if I have the original packaging etc?Never OC'd it or anything like that.

my guess is that you can send the card back as long as the warranty is still valid.
 
give them a call and ask for an RMA. they'll check the serial number of the card to determine if its still in warranty. if it is, you need nothing more than the card and a static bag to send it to them. i've never rma'd an item through ATI, but i'd be willing to bet they'll cross-ship with a valid CC#, meaning they'll send you a new card before you send your dead one out to them.
